Terms of Service

These Terms of Service ("Terms") govern your use of the Mike and Karen Murphy website (the "Site"), including browsing artwork, messaging the studio, and purchasing original works. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site to purchase or submit messages.

Eligibility

You must be at least 18 years old (or the age of majority where you live) to place an order. By submitting an order, you confirm that you meet this requirement and that the information you provide is accurate.

Artwork sales

Listings describe original works offered for sale while marked available. Prices are in United States dollars (USD). Each purchase is of the physical artwork described; color and detail on screens may differ slightly from the work in person. We represent that works sold as originals are original works by Mike Murphy or Karen Murphy as attributed on the listing. Online checkout offers free shipping within the United States only, insured and by UPS, unless a listing says otherwise. International shipping is not offered through the Site—contact the studio for other arrangements.

Orders and payment

Placing an order creates a pending purchase record. Payment is completed through PayBright's secure hosted fields and payment processing. Card details are handled by PayBright; we do not store full payment card numbers on this Site. An order is confirmed after successful payment. Title to the artwork transfers after successful payment and remains subject to successful delivery arrangements. Applicable taxes may apply to your purchase depending on where you live and how sales are fulfilled.

Cancellation, returns, and shipping damage

Because each piece is a unique original, all sales are final once payment succeeds, except where the law requires otherwise or where we agree in writing. If artwork arrives damaged, contact us within seven (7) days of delivery with photos of the packaging and the work. We will work with you and the carrier's insurance to arrange repair, replacement with a comparable work if available, or another remedy we agree on. If you need to cancel before payment completes, simply leave the checkout; unpaid pending orders are not charges.

Messaging and user content

Studio messages must be respectful and related to artworks or studio inquiries. By submitting a message, you grant Mike and Karen Murphy a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and moderate that content on the Site and in studio operations. You represent that you have the rights to submit the content and that it does not infringe others' rights or contain unlawful, defamatory, harassing, spam, or misleading material, or personal information about someone else without permission.

We may edit, hide, or remove messages or replies, and we may refuse to reply, without obligation to monitor every submission. Phone numbers submitted with messages are private to the studio. To report a public note, use the "Report this note" link on the thread or email mbmurphy40@gmail.com.

Prohibited uses

You may not misuse the Site, including by attempting to interfere with security or availability; scraping or harvesting content or personal data at scale; submitting malware or automated spam; impersonating others; or using the Site for any unlawful purpose. We may suspend access that violates these Terms.

Intellectual property

Images, text, branding, and other content on this Site are protected by copyright and related rights. Viewing the Site or purchasing a physical artwork does not transfer reproduction, merchandising, or other intellectual property rights unless a separate written agreement says otherwise. You may not scrape, copy, or commercially reuse Site content without permission.

DMCA / copyright complaints

If you believe material on the Site infringes your copyright, send a notice that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the material claimed to be infringing and where it appears; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized; and (6) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner. Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent allowed by law, Mike and Karen Murphy disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement regarding the Site itself. Artwork descriptions are provided in good faith; local consumer laws may give you additional rights that cannot be waived.

Limitation of liability

To the fullest extent allowed by law, Mike and Karen Murphy is not liable for indirect, incidental, special, consequential, or punitive damages arising from Site use or from delays or failures outside our reasonable control. Our total liability for any claim related to an order is limited to the amount you paid for that order.

Indemnification

You agree to defend and indemnify Mike and Karen Murphy and its artists from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your user content, or your violation of these Terms or applicable law, to the extent permitted by law.

Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, labor disputes, utility or carrier failures, cyberattacks, government actions, or shortages of materials.

Governing law and venue

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. Courts located in South Carolina have exclusive jurisdiction over disputes arising from these Terms or the Site, except where applicable law requires otherwise for consumers.

Changes

We may update these Terms from time to time. The "Last updated" date at the top will change when we do. Continued use of the Site after updates means you accept the revised Terms for future use of the Site. Checkout and message forms require affirmative agreement where shown.
